Travel expenses are subject to loss, up to the entire amount of the fare, and/or require the expenditure of additional money should you elect to change dates, change passengers, or cancel your reservation. This includes monies paid toward any reservation that includes non-refundable fares and/or deposits.

I have been advised by my travel agent, and understand, that my reservation may be subject to fees and penalties, up to the entire price of my package should I elect to make changes to my package, modify travel dates, or cancel my reservation. Note: These Terms & Conditions apply to your full vacation booking, including all individual reservations that may be part of your itinerary.

Magical Moments Vacations Terms and Conditions

All travel carries the possibility of inherent risks. It is important that you understand your responsibilities related to your travel arrangements. When you make a reservation, you and those on whose behalf you are booking enter into an agreement with Magical Moments Vacations (MMV) and with the suppliers who provide services for your vacation, tour, or group package. All reservations are subject to the Terms and Conditions outlined below.
 

1. SCOPE OF SERVICE & ELIGIBILITY

Magical Moments Vacations provides services to assist in researching travel destinations and facilitating the booking of travel-related services. These services are provided solely for personal and non-commercial use.

  • Age: You must be at least 18 years of age and legally authorized to enter into contracts.

  • Currency: All bookings, quotes, and payments are processed and managed strictly in United States Dollars (USD).

  • Residency Restrictions: Due to specific state licensing requirements, Magical Moments Vacations cannot book vacation packages for clients residing in the state of Hawaii. By booking with MMV, you certify that you are not a resident of Hawaii.
     

2. TRAVEL INSURANCE

I acknowledge that I have been informed that travel insurance is available to protect my travel investment. I understand that travel insurance offers specific benefits and has limitations, and that coverage varies by policy. I have been advised to review the full policy details provided by the insurance company and to contact the insurer directly with any questions about coverage. I also understand that my personal medical insurance may not provide coverage outside of the United States.

If I choose not to purchase travel insurance, I understand that I may lose up to 100% of the cost of my cruise, vacation package, or travel arrangements, plus any applicable cancellation fees, if my trip is cancelled or delayed.
 

3. CREDIT CARDS AND CHARGEBACKS

Magical Moments Vacations acts solely as a booking agent for third-party travel suppliers. If a travel supplier is unable to provide contracted services, your remedy lies with the supplier and not Magical Moments Vacations. You agree that:

  • You will not dispute or charge back payments submitted to suppliers on your behalf.

  • You are responsible for any costs incurred by MMV due to chargebacks, including attorney’s fees.

  • You are authorized to approve all charges made to the credit card(s) provided.
     

4. HEALTH, SAFETY, AND HAZARDOUS MATERIALS

  • Health & Vaccination: It is the traveler’s responsibility to verify and comply with all health requirements, vaccinations, and prophylactic medications required by their destination. We recommend consulting the Centers for Disease Control (CDC) and World Health Organization (WHO) prior to travel.

  • Hazardous Materials: Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in imprisonment and financial penalties. Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials.   • Insecticide Notice: Some nations require aircraft cabin insecticide treatment for incoming flights. Refer to the Department of Transportation (DOT) website for a list of these countries.
     

5. BOOKING AGENT DISCLOSURE

Magical Moments Vacations acts solely as a booking agent for third-party travel suppliers and is not the source or provider of travel services. You acknowledge that the listed suppliers are responsible for providing purchased services. MMV is not liable if a supplier fails to deliver contracted services, fails to comply with applicable laws, or commits negligent acts or omissions resulting in injury, damage, delay, or inconvenience.
 

6. TRAVEL DOCUMENTS & LEGAL ENTRY

You are responsible for presenting required travel documents at all times.

  • Passports: Must be valid for at least six months beyond your return date. Names must exactly match your government-issued identification.

  • Legal Entry: MMV is not responsible if a traveler is denied entry into a country or boarding of a carrier based on their personal legal or criminal history (including past convictions for DUI/DWI, felonies, or child support arrears). It is the sole responsibility of the traveler to research eligibility to enter their destination country.
     

7. RESERVATIONS, PAYMENTS & PRICE INCREASES

Payment terms vary by supplier or group package and are outlined on your invoice or contract.

  • Methods: Credit cards are the preferred method of payment. Checks or money orders are accepted in USD only and payable to: Magical Moments Vacations, 2447 Tiffin Ave #196, Findlay, OH 45840.

  • Fees: A $50 processing fee applies to all checks and money orders. No processing fee applies to credit cards or gift cards.

  • Price Increases: I understand that suppliers may impose post-purchase price increases due to taxes, government fees, fuel surcharges, or exchange rate fluctuations. I authorize MMV to process additional charges after notification.
     

8. FORCE MAJEURE & LIABILITY LIMITATION

Magical Moments Vacations is not liable for delays, losses, or interruptions caused by events beyond its control, including Acts of God. Liability is limited to the amount paid for services.
 

9. CLAIMS AND DISPUTE RESOLUTION

All claims must be submitted in writing and received within 30 days of the event. Late claims will not be considered. All disputes shall be governed by Ohio law and filed in Hancock County, Ohio, or the home state of the MMV travel advisor.
